Investigative Report: misusing power for determining faith of 22 Border Police Commissioners

Merit, expertise, and commitment for Afghanistan are the slogans that the Ministry of Interior has always used to professionalize the ANP. But in the latest case, documents have been made available to the PMG news, which shows that at least 22 elite and selected police officers have been introduced to their previous duties or functional requirements of this ministry after receiving their training and appointments in ports without legal justification.
Evidence shows that these officers are professional and expert police officers that, after passing the written and reporting exam, they were introduced as high-ranking officers, deputies, and passport officers of the checkpoints and passages of the Border Police Department of the Ministry of Interior; However, on 7/26/1399, during the letter No. (1015/1315), 22 police officers who were newly appointed as the mentioned officers and bellow positions in the country’s ports were canceled. According to the orders (1297, 1298, and 1299) of the Interior Minister, at least 46 officers have been introduced to these ports, but another 22 have returned to their former posts due to unknown reasons.
Evidence also shows that most unidentified individuals have higher and specialized education, and most of them have even studied for a master’s degree. Most of these individuals scored high scores of 65 to 83 percent in two tests taken by the Ministry of Interior.
Holding free competition and trying to reform the port commissariats:
In March 2020, the Ministry of Interior launched an open competition to appoint at least 67 out of 275 eligible police officers as officers, deputies, and visa and passport officers of border police in checkpoints and passages of the borders. The interior shows that most of these people have been appointed to these positions by obtaining excellent grades. Out of 67 people, 46 of them were selected to three places of border police commissars based on the order of the Minister of Interior. Still, out of these 46 people, 22 of them were not assigned to their duties after the Minister of Interior’s serial orders due to the issuance of letter No. 1095. 1315 Interior Ministry recruitment department. Most of the people who were forced to withdraw from the positions and scored 65 to 83 percent in the Interior Ministry exams.
Selection and process of the security clearance of police officers to port commissariats:
After finalizing the written and descriptive test, at least 67 military personnel will be introduced to the intelligence agencies as qualified individuals for a serious investigation into their backgrounds. Orders of the Minister of Interior to determine the position of these officers:
Based on the available evidence, the Ministry of Interior’s leadership in three serial orders (1297, 1298, and 1299) directs the subordinates to introduce them to their selected positions. According to interior minister decree number 1297,1298 and 1299, which was written on 1/7/1399: “The following officers will be appointed from the previous position in the following new position after taking the exam by the committee responsible for implementing the transparency process of the Intelligence and Development Department of the Security Council of the Islamic Republic of Afghanistan. These people would be selected as officers deputy heads and the visa and passport control officer of the Border Police of interior ministry.”
“In 1297 order of interior minister 16 people were introduced as the border police checkpoints and passages officer, according to decree 1298 of interior minister 15 people were introduced as officers of Visa passport control for the border police and according to order number 1299 of interior minister15 people were introduced as the border police checkpoint and passages deputy officers, order 15 people as visa and passport control officers of border police checkpoints, and in 1299 order 15 people as deputy border checkpoint deputies. Border police have been selected. Besides, 21 other officers have been introduced to the Ministry of Interior’s active caution in these three positions based on these orders.”
Order to withdraw from the appointments of 22 police officers:
Evidence obtained by the police shows that 22 soldiers selected for the post of Chief of Staff, Deputies, and Chief of Visa and Passport of the Interior Ministry border crossing of border Police have not been introduced to their posts. Still, another 24 have been assigned to their posts. Evidence also shows that some have achieved excellent marks in the written and descriptive tests among the undecided.
After determining the closure of these soldiers, on 7/26/1399, the General Directorate of Interior minister recruitment office issued a letter No. “1095/1315” to cancel the selection of 22 people; Letter No. 1095 states: “Summary of the matter: Regarding the introduction of the officers appointed in the directorates of crossing and control, deputies and the director of passport control, to the border police! “Based on the guidance of the competent authority, the introduction of the officers mentioned above in the relevant departments should be avoided.”
These 22 soldiers are the ones who have the highest scores on the shortlist, and each of them has a bachelor’s degree in various police departments. Based on Letter No. 1095: “These officers were introduced to seven important ports of the country, including Hairatan, Aqenah, Turghandi, Islam Qala, Abu Nasr Farahi, Spin Boldak and Gholam Khan, of which six as commanders, eight as deputies, and eight other people have not been introduced as the passport holder of the checkpoints and crossing of the General Directorate of Border Police.”
This is stated in letter No. “1095/1315” to the General Directorate of Border Police. “Officers whose previous posts are in short supply shall be deemed to have sufficiently recruited the relevant parts and units, and the officers mentioned above, whose posts have been completed, have been introduced to the active presence of the recruitment General Directorate until the fate is determined.”
Alleged discrimination against the Ministry of Interior:
The introduction of these officers and the withdrawal of Pijenton from the Ministry of Interior from the 22nd police station after passing the written and oral exams also provoked reactions. Some lawyers met with the professor to Article 22 of the Constitution and Article 403 of the Afghan Penal Code. The leadership of the Ministry of Interior is said to have discriminated against these soldiers and abused their official powers. Atmar Shomal, a member of the Afghan Lawyers’ Association, said: “According to Article 22 of the Constitution, the introduction of 24 soldiers to ports and the non-introduction of 22 others is discrimination against Afghan citizens, and based on Article 403 of the Penal Code, the leadership “The Interior Ministry has acted against these officers in violation of the law and has abused their official powers.”
Political and profit-making factors:
The former military believes that such actions by the Ministry of Interior’s leadership may have taken place for several reasons, especially political pressure. Mirza Mohammad Yarmand, former Deputy Minister of Interior, says: “In general, two factors can be considered the main reason for not introducing these people as commissioners.
